This Privacy Statement governs the processing of your personal data by DELA. DELA stands for ‘Draagt Elkanders Lasten’ (Bear One Another’s Burdens) and is the leading funeral specialist in Belgium active in funeral insurance and organisation.

DELA, together with DELA Coöperatie U.A., located at 5611 DD Eindhoven (the Netherlands), Oude Stadsgracht 1 (hereinafter referred to as "DELA Coöperatie"), is collectively referred to as "DELA Group".
DELA values great importance to your privacy and makes every effort to process (your) personal data in a legal, honest and transparent manner. We handle your data entirely in accordance with the applicable laws and regulations, including the General Data Protection Regulation (GDPR).
Therefore, please read this Privacy Statement carefully. It contains essential information about how we process your personal data and what cookies we use. By sharing your personal data on our website, contacting us by email or phone, becoming a DELA customer, or submitting a question or complaint, you confirm your awareness of this Privacy Statement.
Personal data is any information about an identified or identifiable natural person. This may include a person's name, contact details, date of birth, photograph, and any other data that is or can be linked to an individual, such as an email address, phone number (including a work phone number), or login credentials.
The processing of personal data refers to any operation or set of operations performed on personal data. These operations are highly diverse and include the collection, storage, use, modification, sharing, and eventual destruction of the data.
When you apply for a policy proposal for the DELA Uitvaartzorgplan / le Plan de Prévoyance obsèques DELA, we process personal data relating to you as a potential policyholder, insured party, or beneficiary of the insurance contract. In such cases, we process your name, address, date of birth, contact information, account number, gender, your relationship to other parties under the same insurance contract, health information, national registration number, and, in certain instances, a copy of your identity card.
This information is provided to us by the policyholder or the insured, or, in the case of health data, possibly by their treating physician.
We process this data because it is necessary for the formation of an insurance contract and, in some cases, to comply with legal obligations. This includes obligations under insurance laws, anti-money laundering laws, anti-terrorism laws, laws requiring the reporting of dormant funds, and other regulatory reporting requirements. The latter applies particularly to copies of identity cards and national registry numbers.
We retain this data for five years if you apply for a policy proposal but do not enter into an insurance contract, or for thirty years after the end of your customer relationship if you have entered into an insurance contract.
If you are the policyholder, insured, or beneficiary of an insurance contract, we process your personal data to fulfil our agreement with you, or, in the case of health data, because you have given us permission to do so.
The management of your insurance contract includes the following processing operations:
Your data may also be used for our legally required actuarial calculations as an insurer, as well as for financial, tax, and accounting reporting obligations mandated by law.
Your data may also be processed based on our legitimate interests. For example, this is true in these cases:
When managing your customer data, we process your name, address, date of birth, contact details, account number, gender, relationship to other parties under the same insurance contract, health data, national registration number, and possibly a copy of your identity card. We may also process tax and accounting data, invoices, correspondence, and emails.
As a rule, you provided us with this information yourself, or it was provided by the policyholder if you are only a beneficiary or insured under an insurance contract.
We retain this information for the duration of your customer relationship with us and for thirty years after the payment of the insured capital or surrender value.
DELA Verzekeringen requests certain health information from you as a prospective insured. We require your explicit consent to process your health data.
We request your health information as part of the assessment, conclusion, and implementation of the insurance contract. Your health data are processed to assess whether and under what conditions the insurance contract can be concluded, to determine the risk to be insured (determination of the amount of the premium, possible waiting period, alternative proposal), for the payment of the insured capital in the event of death, to verify in the event of death whether your health condition was truthfully communicated at the time of entering into the insurance contract, and to deal with possible disputes.
Only our consulting physician will review and handle your health data. Additionally, your health information will only be shared with individuals who need to know it in the context of a dispute (e.g. a lawyer).
We require your explicit consent to process your health data. As the insured, you have the right to withdraw your explicit consent at any time. This could potentially affect the continued performance of the insurance contract and may, for example, result in the need to surrender your portion of the contract. The actions undertaken by DELA prior to receipt of such revocation shall remain in effect.
You can withdraw your consent by sending a written, signed, and dated notification via email (privacy@dela.be) or by mail (DELA, Attention: Data Protection Officer, Noorderplaats 5 bus 2, 2000 Antwerp), along with a copy of your identity card for identification purposes.
Both insured persons of DELA Verzekeringen and non-insured persons can create a MijnDELA account. As a non-insured person, you must create a MijnDELA account using an email and password. Policyholders with DELA Verzekeringen can additionally log into MijnDELA via e-ID or itsme.
If you are insured with DELA Verzekeringen, you can find all relevant information about your customer relationship with us and the insurance contract(s) you hold as a policyholder or insured in your personal MijnDELA account.
We process your data in MijnDELA because it is necessary for the administration of your insurance contract and the fulfilment of our agreement with you.
In this context, for the general administration of the insurance contract, we process your name, address, date of birth, contact information, account number, gender, relationship to other parties under the same insurance contract, and your national registration number. If you save a will in your MijnDELA account, we will naturally also process the data you enter in it on your own initiative.
As a rule, you provided us with this data yourself or it was provided to us by the policyholder.
We retain your data for the duration of your customer relationship with us and for thirty years after the payment of the insured capital or surrender value. Access to the MijnDELA secure environment is closed upon the surrender or payment of the insured capital.
If you create a MijnDELA account as a non-insured person, we will process your email and password. You can fill out a digital will on which you describe your funeral wishes. The additional data we process about you is entirely up to you, based on the digital will you complete on your own initiative. This may include the names of people in your personal environment, your funeral wishes, the name of your funeral director, your religious beliefs, etc. We process this data in fulfilment of our agreement with you (the preservation of your will and funeral wishes by DELA at your request).
We also process analytical data about the use of your MijnDELA account based on our legitimate interest in improving our services, ensuring the relevance and quality of our communications and service offerings, and maintaining the technical security of MijnDELA.
We may also process your personal data in the context of our customer service. This is the case, for example, when you submit complaints or compliments to us via our website, email, letter, telephone or when we conduct customer satisfaction surveys.
In these cases, depending on the specific situation, we process your name, address, email address, phone number, whether you are a customer, your contract number, the content of your complaint or compliment, your responses to our satisfaction survey, your date of birth, and, depending on the nature of your complaint, potentially health data, your bank account number, and possibly the name of your intermediary. The data we process in this context may vary depending on the situation, but we always ensure that we only process the data that is strictly necessary for each specific case.
We obtain the personal data you share with us in this context directly from you and use it solely for handling your complaint or compliment, or in the context of our customer satisfaction efforts, based on our legitimate interest in improving customer satisfaction and service quality.
After handling your complaint or compliment, or after processing your responses to our customer satisfaction surveys, we retain your data for ten years.
As far as funeral, assistance to bereaved relatives and repatriation is concerned, DELA Verzorgen is responsible for processing your personal data.
6.1. Funeral
Regarding the funeral, DELA is responsible for transporting the body of the deceased, arranging a meeting with the next of kin to plan the funeral, requesting the death certificate, handling the administrative formalities related to the funeral (such as cremation requests, disposal of ashes, and cemetery concessions), preparing and ordering printed materials, posting the obituary online (subject to explicit permission), organising the funeral ceremony, and conducting the ceremony itself. For you as a customer (next of kin, contact person), this is done as part of the fulfilment of our agreement with you.
For this purpose, DELA processes the following data (depending on the specific case):
Regarding the deceased: name, first name, place and date of birth, destination of the deceased's body, and death certificate.
Regarding the client: name, first name, relationship to the deceased, phone number, email address, address of the meeting with the next of kin, date of birth, and place of birth.
DELA also processes image recordings during the funeral, access control in funeral homes, contact details of doctors, administrators, police, Public Centre for Social Welfare (PCSW), other relevant agencies, and any other data that may be required.
DELA retains this data for twenty years, with the exception of image recordings and camera surveillance footage, which are retained for only four weeks.
However, in the context of practical follow-up after a death and maintaining the contact network necessary for DELA to provide its services, contact details of third parties are also processed (such as public services, transport services, doctors, PCSW, municipal social services, next of kin, ministers of worship and funeral homes). Their data is processed on the basis of DELA's legitimate interest to ensure initial support in the event of death for its customers or in the case of requesting the death certificate and handling the deceased's transport because there is a legal obligation to fulfil the necessary administrative formalities. DELA retains this data for twenty years.
6.2. Bereavement support
In terms of assistance to bereaved relatives, DELA provides guidance to the next of kin in handling administrative formalities following the death, as well as offering advice regarding their obligations in declaring the estate and referring them to specialists in the matter.
In this context, DELA processes your name, address, e-mail, phone number, gender, language and your reference or customer number. In some cases (for example, when requested by governments or third parties), we may also process your ID card number, marital status, and the identity information of your children, along with the identity details of the deceased.
DELA retains this data for ten years.
6.3. Repatriation
DELA arranges repatriations from A to Z, regardless of the country of death or destination, and irrespective of the nationality or religion of the deceased. This service is typically provided on behalf of Belgian and foreign travel assistance insurers, emergency centres, funeral directors, embassies and consulates, companies with employees abroad, or companies with foreign nationals at their Belgian headquarters.
As soon as DELA is notified of a death, its practical assistance begins, focusing on organising the transportation of the deceased. DELA takes care of the transportation of the body and all related administrative obligations, including, for example, requesting the death certificate, obtaining all necessary authorisations and transport documents, and organising the transport itself.
For this purpose, DELA processes the following data (depending on the specific case)
DELA retains this data for ten years.
In the context of practical follow-up after a death and maintaining the contact network necessary for DELA to provide its services both domestically and internationally, contact details of third parties are also processed (foreign governments, embassies and consulates, customs, transport services, doctors, etc.). Their data is processed based on DELA's legitimate interest in providing initial bereavement support for its customers or, in some cases, because there is a legal obligation to complete the necessary administrative formalities for the repatriation of a deceased person.
DELA retains this data for the period that the contacts are active.
If you visit our website and complete one of our contact forms to request information, make an appointment, request an obituary, or download a brochure, we process the data you provide. Typically, this includes your name, email address, address details, telephone number, contract number if you have taken out an insurance contract, and the content provided in the form (e.g. appointment requests, information requests). We process this data in performance of a contract with you (handling your request on your initiative) and keep the data from these forms for up to six months.
You can simulate a premium calculation on our website. This gives you as a potential customer of DELA Verzekeringen an indication of the premium you would owe if you actually took out an insurance contract with us. In this case, you provide us with your name, first name, gender, date of birth, e-mail address, and family composition, which we then process in order to fulfil our agreement with you (such as calculating a premium estimate as requested). The data you share with us will be retained for six months.
You may visit our website to request a premium calculation for an insurance contract after reading an article on our site or in an email from one of our partners or intermediaries within our network. In that case, we also process analytical data that enables us to link your request to the article or email that referred you to us. We do this based on our legitimate interest in providing feedback to our partners and intermediaries and measuring the effectiveness of our communication campaigns. This analytical data is retained for up to two years.
On our website, you will also find a live chat feature that lets you connect directly with our communications team, as well as a chatbot that provides automated answers to frequently asked questions. If you are an existing DELA customer using the live chat or chatbot, we process your name, email address, date of birth, contract number, and the content of the live chat itself. If you are not yet a customer, you only share with us the content of the chat itself. We do so in execution of a contract with you (answering your questions as requested). We also process statistical and technical data associated with the chat session that allow us to analyse the use of the live chat and chatbot and improve its operation. We do this based on our legitimate interest in continuously improving our services. Chat sessions are retained for up to nine months.
If you arrange a funeral with DELA, an online condolence book can be created, where the obituary will be published only with the customer's permission. This obituary will remain on the online condolence book until the client, who is responsible for this processing in this case, decides to delete it. We also process names, addresses, email addresses, and any data that you provide in the online condolence book, as well as any information left by visitors to the registry. The processing of data as part of the online condolence book is carried out with the explicit consent of the client arranging the funeral. Visitors to the online condolence book can leave condolences, they can light a virtual candle and order flowers. We process their data, such as name, address, email address and flower order and payment details, based on the performance of a service agreement we enter into with them. This data is retained as long as the condolence book itself is kept. The online condolence book can be transformed into a printed book of remembrance upon the request of the deceased's next of kin. This book will contain a full copy of all condolence messages, as well as details of candles and flowers left in memory, which will be printed on paper for the next of kin. This book will, of course, remain with the next of kin, and DELA will not retain a copy. Inappropriate condolences may be deleted, if you report an inappropriate condolence, we will request your e-mail address as a means of verification to prevent abuse.
When you visit our website, we also ask your permission to set cookies (see further in the ‘Cookies’ section for more information on our use of cookies). If you allow us to set analytical cookies, we will collect information about your browsing behaviour on our website, such as your IP address, limited location data, unique online ID, details about the device you are using, the website you came from, and your browsing activities on our site. We do this to enhance and personalise your user experience on our website, tailoring it to your preferences. In other words, we aim to display content that is most relevant to your interests. We retain this data for two years.
Business telephone and chat conversations may be recorded and retained by us. We do this for quality monitoring purposes. To optimise our service and enhance its quality, we carry out quality monitoring. It also allows us to demonstrate our compliance with laws and regulations. An example of this is the information obligation we have towards you under privacy regulations.
Phone calls are retained for up to six months. After that, the data is destroyed.
Important information:
DELA regularly sends newsletters, mailings, and other communications to its customers, intermediaries within its network, or anyone who voluntarily subscribes and requests to receive communications from the DELA Group.
We process your name, email address, title (Mr, Mrs, Ms, etc.), and language preference. If you are one of our intermediaries, we also process your broker ID and company details. We got this data directly from you.
Some of our communications are tailored based on your interests, location, age, or other personal criteria. In such cases, we also process the criteria that enable us to tailor our communications to meet your personal expectations and interests. This is data you have provided to us yourself and of your own accord.
If you are an existing customer or an intermediary in our network, we have a legitimate interest in processing your data in this context. If you are not yet a customer, you have given us prior consent to contact you.
We also process analytical data to measure the effectiveness of our communication campaigns. This data is generated by our mailing applications and processed based on our legitimate interest in analysing reader behaviour and improving our communications accordingly.
We retain your data in our communications database until you unsubscribe or for up to two years after our last contact with you (e.g. via email, phone, customer interaction, correspondence, or attendance at our events).
In order to offer you a personalised user experience and personalised communication and product proposals as an existing or future DELA customer, DELA stores your personal profile. To do this, we use your contact details, your stated preferences, your customer history and your interactions with us. We keep your profile for 5 years after your last interaction with us or, if you become a customer in the meantime, for 5 years after the end of your customer relationship with us. If you are not yet a customer of ours, you consent to this when you ask to be kept informed about our products and services.
DELA also maintains social media accounts. For example, you can find us on Facebook, Instagram, Messenger, LinkedIn, Google and YouTube. When you visit our social media accounts, it is important to understand that you are sharing personal data with the company that operates the respective social media platform. This is beyond our control and responsibility. If you wish to understand how social media platforms handle your data, we recommend carefully reviewing the privacy statement of each platform.
When you interact with us on our social media, you also share personal data with us. You share this data on your own initiative, and we process it based on our legitimate interest in maintaining contact with you. Exactly what data we process depends entirely on you. For example, you might share your profile name or username, real name, photo, contract number, address details, or any question you ask or comment you leave.
Comments you leave on our company pages will remain until you delete them yourself. One-on-one communications with you via social media are stored for six months.
DELA also runs targeted advertising campaigns in cooperation with third-party partners. By doing so, we aim to target our message specifically to those who are interested in our products and services, rather than to individuals who would prefer not to receive it. To this end, we work with partners who display our ads on their websites when you visit them. We do this based on data about you that our partners hold, which we do not have direct access to. We only collect analytical data to measure the efficiency of our communication campaigns once you land on our website, based on our legitimate interest in optimising our online communication. Specifically, this includes your IP address, limited location data, unique online ID, information about the device you use to visit our website, the website from which you were referred, and your browsing behaviour on our website. We retain this data for six months. Once you share additional data with us on our website, such as when you fill out a form or request a premium calculation, we will naturally collect other relevant data about you, as outlined under the corresponding sections in this privacy statement.
If you are already a DELA customer, we also aim to avoid showing you our ads again unnecessarily when you browse other websites. Based on the personal data we already hold about you as a customer (as outlined in "How we manage our insurance contracts"), we aim to exclude you from the target groups for our online advertising campaigns. We have a legitimate interest in not disturbing you as a customer unnecessarily and in optimising our own communications.
DELA Group organises events such as memorial services, information evenings on grief and succession, or participates in third-party fairs and events. We also send invitations to these by mail or email. In that context, we process personal data of attendees such as their name, address, email and phone number. We do this based on our legitimate interest in maintaining and strengthening our relationship with our current and potential future customers. Participant data will be retained for one year after the event, reminder service, or information evening.
Coöperatie DELA is an independent legal entity whose goal, across national borders, is to enable a dignified and affordable farewell for its members.
If you become a member of Coöperatie DELA, your personal data will be processed not only by DELA but also by Coöperatie DELA, which acts as a separate and independent data controller. Coöperatie DELA thus processes your name, your address, your email address, your address, your language preference, your insurance contract policy number, your family composition, your date of birth and other personal data that you may share with Coöperatie DELA.
Coöperatie DELA processes your personal data in order to fulfil the terms of your membership agreement. This includes managing your membership, informing you about its activities, keeping you updated on the benefits associated with membership, and administering your subscription to these benefits. Additionally, your data may be used for internal activities such as member panels, dispute committees, the Successio help desk and organising Theme Days.
Coöperatie DELA also sends advertising emails and mailings to non-members. Of course, this is done only with your prior permission.
Your personal data will be kept by Coöperatie DELA for as long as you remain a member of Coöperatie DELA. Personal data of former members will be deleted within no later than twelve months after the end of membership.
If you act as an intermediary (broker, distributor, agent, or sub-agent) for DELA Verzekeringen, we process your personal data as part of our cooperation, depending on the specific nature of that relationship. This may include your name, business address, KBO/BTW number, producer number, FSMA number, broker ID, nationality, e-mail address, telephone number, bank account number, contacts within your company for DELA, language preference, date and place of birth, signature, and a copy of your ID card. We also process data related to the insurance contracts or customer contacts associated with you, along with administrative, contractual, and analytical data concerning your commercial relationship with us. This includes information about your activities carried out on our behalf, as well as details of any training and continuing education courses you have undertaken.
We process this data because it is necessary for the execution of our cooperation agreement with you, to manage our administration, to pay your commissions, and to ensure the delivery of our services to our customers. Additionally, we process this data as part of the training courses and events we organise for you.
All the data we process about you as an intermediary has been provided by you directly.
We retain this data for the entire duration of our cooperation and for ten years following its conclusion.
If you are a supplier to DELA Group, we process your supplier data as part of our business relationship. This typically includes your company information, contact details for relevant staff members, as well as financial and billing information. This data is provided to us by you, the supplier, and we process it to fulfil our agreement(s) with you. We retain this data for ten years in compliance with our accounting obligations.
In providing our services, we may also process personal data from third parties. These may include trustees, holders of power of attorney, doctors, physicians, fiduciaries, debt mediators, PCSW employees, lawyers, notaries, funeral directors, aftercare consultants, funeral homes, ministers of worship, and others. We process personal data such as names, contact information, billing and contract details, proof of mandate, and account numbers.
This data is always processed because it is necessary for the execution of our contracts with our customers. We have a legitimate interest in processing the data of these third parties in this context or based on the agreement we may have entered into or will enter into with the third party in question.
We receive the data of such third parties from the third party itself, from our customers, or from other third parties who provide it to us. We use the data only for the purposes for which it was provided to us and, depending on the situation, we do not retain it longer than necessary to fulfil our contractual and legal obligations.
We may also actively seek partners or potential acquiring funeral homes and funeral directors, and in this context, process names, contact details, company information, financial data, and personnel data based on our legitimate interest in pursuing prospects that support our services. This data is retained for ten years.
Whistleblowing refers to the confidential or anonymous reporting by DELA employees or external parties of illegal, unfair, or abusive behaviour within DELA Group's business activities, ensuring protection for the reporter from retaliation. The reporter is also referred to as the Whistleblower.
When you are a Whistleblower or a person named in the report, we process personal data about you.
When we receive a report, a file is created containing the details of the report. This file contains the identity, contact details, position or relationship to DELA Group, details about the reported breach, and any other relevant information provided by the Whistleblower about themselves or the person named in the report. We will keep the information provided confidential.
We do not intend to collect or process special categories of personal data, such as information about racial or ethnic origin, political beliefs, religious or philosophical beliefs, or health-related information. However, if we receive any special categories of personal data in the context of a report, we will handle them with the highest degree of security and confidentiality.
In some cases, the Whistleblower may choose to report anonymously. In this case, we will take all necessary steps to ensure that the Whistleblower's identity remains confidential and is not disclosed to others.
If there is any information in the report that should not be disclosed in the context of an investigation, we will ask the Whistleblower to clearly indicate this when submitting the report.
We will collect and process the personal data mentioned above solely for the purpose of receiving and processing whistleblower reports.
Personal data mentioned in whistleblower reports related to a report are processed based on our legal obligation, as this information is necessary to comply with the Act of 28 November 2022 on the protection of whistleblowers within legal entities in the private sector (Whistleblower Act).
The processing of your personal data is also necessary for the protection of our legitimate interests, including defending ourselves in case of legal proceedings.
We will ensure that the identity of the Whistleblower, and any other information from which the identity of the Whistleblower or the person named in the report can be inferred (directly or indirectly), is accessible only to the reporting administrator(s) and the investigation team (if applicable) who are authorised to receive and follow up on the report.
All internal and external parties involved in the receipt, follow-up, investigation, and any further actions related to the report are bound by strict legal or contractual obligations to keep your personal data secure and confidential.
Your personal data will only be disclosed to supervisory authorities if required by law.
We do not share your personal data with third parties for commercial purposes, except with your prior consent.
However, if necessary for internal reorganisation or the transfer of activities, we may transfer your data to other entities within DELA Group or to third parties to ensure the continuity of our services. We will always inform you in advance whenever possible in such cases, but you understand that this may not be technically or commercially feasible in all circumstances.
DELA collaborates with a network of brokers, distributors, intermediaries, agents, and sub-agents. Depending on how you contact DELA, your information may be shared with the broker, distributor, mediator, agent, or sub-agent you are in contact with or wish to contact. If we share your information in this way, we will ensure that you are kept informed as promptly and accurately as possible, either by us or by the broker, distributor, agent, or sub-agent involved.
DELA may engage external processors to provide specific services. These service providers will carry out the processing operations on our behalf and at our request (in the capacity of processor). These include service providers we engage for a wide range of administrative, IT, and accounting services. An up-to-date list of the external processors with whom we share personal data is available upon request via privacy@dela.be
DELA will carefully select processors in accordance with applicable data protection laws. Additionally, DELA will ensure that processing activities are conducted in compliance with the terms of any written agreements and in accordance with applicable data protection laws and regulations.
We try to use European suppliers whenever possible, but if we need to use non-European third parties, we will ensure that your data is just as safe outside Europe as within Europe. For example, where necessary, we sign Standard Contractual Clauses with these partners and ensure that additional safeguards are in place.
However, in rare cases, we may be required to disclose personal data pursuant to a judicial order or to comply with other mandatory laws or regulations. We will make every effort to inform you in advance, unless this is not possible for legal reasons.

When exercising your rights, DELA will need to verify your identity to ensure that no one else is acting on your behalf without your consent. Therefore, if necessary, we may verify your identity and request a copy of your identity card if we have any doubts. We have implemented appropriate technical and organisational security measures to protect your personal data. For example, our servers and software tools are protected with usernames and passwords, access is restricted, and encryption is used whenever possible. Under no circumstances may DELA be held liable for any direct or indirect damage resulting from an erroneous or unlawful use by a third party of the personal data.
